Terms
Terms of Service.
Version en-au-2026-11b, last updated 3 November 2026
1. Who we are and who these terms are for
1.1 Kettlebury is the trading name of Moritz Reiß, a sole trader in Germany, Hofmatte 20, 79232 March, Germany (“we”, “us”). Contact: hello@kettlebury.com.
1.2 We sell only to businesses: people and organisations buying a website for their trade, business or profession, including sole traders and people starting a business. We do not sell to people buying for personal or household use. When you order, you confirm with a required tick box that you are buying for your business.
1.3 Your own terms do not apply, even if you send them to us.
2. What you get
2.1 We turn the free preview you have seen into a finished website for your business and keep it running while your subscription lasts. This includes:
- finishing the website from the preview, including up to 3 free rounds of changes before it goes live;
- hosting with https, technical maintenance and security updates;
- registering a domain in your name and managing it technically (clause 6);
- up to 3 small changes per month after go-live.
2.2 A round of changes is one list of change requests you send us at once (in the onboarding form or using the form in your customer area). We make them and send you the updated site. Before go-live, these rounds also cover bigger requests on the existing pages, for example new texts, other photos, a different layout, other colours or extra sections. New pages and new features are not included; we quote them separately. Requests after the third round are handled after go-live as small changes or quoted separately.
2.3 A small change is one we can do in about 15 minutes, for example new opening hours, a new price, swapping a text or a photo. Unused small changes do not roll over. Bigger requests after go-live (new pages, new features, a new design) are quoted separately.
2.4 Go-live: your website goes live within 2 business days after you approve it (clause 4). Delays caused by missing information from you or by the domain registry move this date accordingly.
2.5 We aim for high availability but do not promise uninterrupted service.
3. Ordering and payment
3.1 The preview and the order page are not a binding offer. On the order page you choose your plan and your domain, enter your details and tick the required boxes (business purchase, these terms, the DPA). Clicking “Order and pay” takes you to the Stripe checkout; completing payment there is your binding order. The contract starts when payment succeeds and we confirm your order by email; the confirmation includes these terms and the DPA.
3.2 Payment is automatic only, by card or PayPal through Stripe. By ordering you authorise us to store your payment method with Stripe and to charge it, without you being present, for the fees in clause 3.3 and any additional domain cost in clause 6.3. We email you at least 2 days before each charge with the date, the amount and the invoice. We do not send invoices for manual payment.
3.3 At order you pay the setup fee, which includes registering your domain and its first year (clause 6). Your plan fee (monthly or yearly) is first charged one month after your website goes live (the day it is online at your domain; we email you the date then), and after that automatically at the start of each period until you cancel. On the instalment plan there is no setup fee: you pay the first monthly instalment at order, then one each month.
3.4 Prices: the setup fee, the plan fee and the instalment are as shown in your offer on the order page; we confirm them in the order confirmation. The yearly plan costs 10 monthly fees. You see the total before you pay.
Prices are net. Our services are supplied from Germany to businesses outside the EU and are not subject to German VAT (place of supply: customer's country, § 3a (2) UStG). Any local taxes (GST, sales tax) are the customer's responsibility.
3.5 Failed payments: if a payment fails, we email you and give you 7 days to pay or update your card. After that we may take the website offline until payment is made.
4. After you order: onboarding, deadlines, approval
4.1 You choose your domain on the order page, before you pay: a new domain (we check that it is available) or one you already have. After payment you get a link to a short onboarding form: details for your legal notice/contact page, confirming contact details, hours and services, whether to show reviews, confirming photos, and your change requests for the first round of changes.
4.2 Domain taken in the meantime: we register the domain you chose right after payment. If someone else registered it between your order and our registration, we email you available alternatives; we register one only after you pick it. Until then the site is not published under a domain.
4.3 Your website is ready: when your details and changes are in, we email you “Your website is ready” with a link and an “Approve” button. You can approve it or tell us what is still wrong or what you would like different; while you have rounds of changes left (clause 2.2), this is free.
4.4 14-day approval period and deemed approval:
- (a) You have 14 days from the “Your website is ready” email to approve the site or tell us what is wrong.
- (b) That email states clearly, with the date, that the site will count as approved and go live if you neither approve nor report a problem by then. We send reminders on day 7 and day 12 with the same notice.
- (c) If you do not respond within the 14 days, the website counts as approved and we publish it within 2 business days.
- (d) If you report a problem or send change requests from a round you still have, we make the changes and send a new “Your website is ready” email; the 14 days start again. Fixing a genuine error (something that does not match your onboarding answers or the preview) does not count as a round of changes.
- (e) Photos you have not confirmed and reviews you have not approved are never published, even after deemed approval. If details required for your legal notice are missing, we do not publish and keep reminding you.
4.5 Changes after go-live use your monthly small changes (clause 2.3).
4.6 If you pay and never respond, we finish the site from the preview and follow clause 4.4. You have paid and you get your site.
5. No money-back guarantee
There is no money-back guarantee. Your rights under law that cannot be excluded stay unaffected (clause 12.4).
6. Your domain
6.1 The domain is registered in your name as registrant. We manage it technically through our registrar account and point it to your website.
6.2 Registration is also subject to the registry’s rules (for example auDA for .au, InternetNZ/DNCL for .nz, ICANN registrant rules for .com). You authorise us to register the domain in your name on those terms. The details you give (name, address, business number, email) must be correct because they go to the registry.
6.3 The setup fee covers domain registration and the first year; there is no separate domain fee. From year two, renewal is included in your plan fee while the subscription runs. If a domain costs more than the included amount (about 30 EUR a year; the limit in your currency is shown on the order page), the amount above that is charged as additional domain cost. We show it before you pay; it is due at order and again with each renewal of the domain. Only available domains can be ordered.
6.4 When your subscription ends, we give you the transfer code on request and help move the domain to you or your new provider. You pay renewals after that yourself. If you do not ask for the code, we stop renewing and the domain may lapse.
6.5 If you already have a domain, we move it or you add our DNS records; the setup fee stays the same.
7. Term and cancellation
7.1 Monthly plan: you can cancel to the end of any billing month, at the earliest to the end of the first paid month (it starts one month after go-live, clause 3.3). Your cancellation must reach us at least 14 days before the end of the billing month, otherwise it takes effect at the end of the next one. Switch to yearly: you can switch to the yearly plan at any time using the form in your customer area (linked in every invoice and confirmation). Before your first monthly fee, your first fee is then the yearly fee (clause 3.3); after that it takes effect from your next billing date (the current month stays paid, then the yearly fee is charged).
7.1a Instalment plan: minimum term of 24 months from the start; the earliest you can cancel is the end of the minimum term. After that it continues as a monthly plan at the normal monthly fee without you doing anything; you can then cancel as in 7.1 (14 days’ notice to the end of a billing month) or switch to yearly.
7.2 Yearly plan: the first year starts with the first yearly fee, one month after go-live (clause 3.3). It runs for one year and renews automatically for another year unless you cancel with at least 14 days’ notice before the renewal date. We email you at least 30 days before each renewal with the date, the amount and a cancel link. If you cancel mid-year, the site stays live until the end of the paid year; there is no pro-rata refund.
7.3 You cancel using the form in your customer area (linked in every invoice and confirmation), online, without calling us; an email to hello@kettlebury.com or a reply to any invoice or reminder email also works. We confirm by email.
7.4 We may end the monthly plan with 4 weeks’ notice, the yearly plan at the end of a year and the instalment plan at the end of its minimum term at the earliest. Either side may end the contract immediately for a serious breach by the other.
7.5 After the contract ends we take the site offline. If you ask within 30 days, we send you the texts and photos of your site as files.
8. Data after the contract ends
We delete the website and your content 30 days after the contract ends. We keep invoices and payment records as long as tax law requires. Details are in our privacy policy.
8a. Data processing
8a.1 When we host your website we handle personal information on your behalf, such as visitor server logs and, if you switch it on, contact form messages. Our Data Processing Agreement (DPA), attached to these terms, applies to that. It is part of these terms and starts with your order.
8a.2 You accept the DPA with its own tick box when you order. We email you these terms and the DPA as PDF files with your order confirmation.
8a.3 If these terms conflict with the DPA, the DPA prevails. We tell you about changes to the DPA, including new sub-processors, by email under clause 13.
9. Content, photos and reviews
9.1 The preview uses photos and reviews from your business’s own public profiles (for example Google Business Profile, Facebook, Instagram), or suitable example photos where we have none of yours. In onboarding you confirm for each photo that your business may use it on the website (you took it or hold the rights) and that people shown in it agree. Only confirmed photos go live.
9.2 Reviews are shown only if you choose so, with first name or initials and source.
9.3 You are responsible for content you provide or confirm (texts, photos, legal notice details, prices, services) being accurate and lawful.
9.4 We may refuse or remove content that is unlawful or infringes someone else’s rights.
10. Who owns what
10.1 The design and code of the website remain ours. While your subscription runs you may use the website for your business.
10.2 Your own content (texts you supply, photos, logo) stays yours. You let us use it for your website while the contract runs.
10.3 We may show your live website as an example of our work unless you tell us not to.
11. Problems with the service
If something does not work as agreed, tell us through the contact page. We fix hosting and website faults within a reasonable time and treat outages as urgent.
12. Liability
12.1 We are not liable for indirect or consequential loss, such as lost profits or lost business.
12.2 Apart from clause 12.4, our total liability under this contract is limited to the fees you paid in the 12 months before the claim.
12.2a For services that are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failure to comply with a consumer guarantee is limited to supplying the services again or paying the cost of having them supplied again.
12.3 We are not liable for failures of third parties outside our control (domain registries, payment provider, data centre) unless we caused them.
12.4 Nothing in these terms excludes or limits any right or remedy you have under law that cannot be excluded or limited, including under the Australian Consumer Law and the New Zealand Fair Trading Act. Nothing limits liability for fraud, wilful misconduct or gross negligence.
13. Changes to these terms
We tell you about changes at least 4 weeks in advance by email. If you do not agree, the old terms continue to apply until you or we end the contract under clause 7. We do not raise prices through this clause; a price change needs your agreement or applies only from your next renewal after at least 30 days’ notice, with the right to cancel before it takes effect.
14. Law and disputes
14.1 These terms are governed by German law, except where the law of your country applies by force of law and cannot be contracted out of.
14.2 Before going to court, we both try to solve the problem by email within 30 days.
14.3 The courts of Freiburg im Breisgau, Germany, have non-exclusive jurisdiction. You may also bring proceedings in the courts of the country where your business is based.
